These Terms of Service (“Terms”) govern your access to and use of alexanderprobert.com, including any related pages, newsletters, checkout pages, membership or course areas, and content made available through the site (collectively, the “Site”). The Site is operated by Alexander Probert (“I,” “me,” “we,” or “our”).
By accessing or using the Site, creating an account, purchasing a product or course, submitting a form, or otherwise engaging with the content, you agree to these Terms and to the Privacy Policy posted on the Site. If you do not agree, do not use the Site.
If you use the Site on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.
1. Who I Am; Real Estate License Disclosure
This is a personal and professional website. It may include a blog, digital products (including e-books), online courses, and information about real estate services and related products.
Licensed real estate activity, when offered, is conducted by Alexander Probert as a licensee affiliated with Chad and Sandy (brokerage website: https://chadandsandy.com). For advertising and compliance, real estate services are identified with the brokerage Chad and Sandy. Online marketing may use the Chad and Sandy name and site for a consistent public-facing brand. Visiting alexanderprobert.com, reading the blog, buying an e-book or course, or sending an inquiry does not by itself create an agency, fiduciary, or brokerage relationship. A brokerage relationship, if any, arises only under a written agreement that complies with applicable state law and brokerage policy, and only in jurisdictions where the licensee is authorized to practice.
I support the Fair Housing Act and equivalent state and local fair housing laws. Real estate services and advertising will not discriminate on the basis of race, color, religion, sex (including gender identity and sexual orientation), national origin, familial status, disability, or any other status protected by law.
Blog posts, market commentary, neighborhood information, calculators, sample materials, and similar content are general information and marketing. They are not an appraisal, inspection, legal advice, tax advice, lending advice, or a guarantee of value, timing, or outcome. Listing information, if shown, may come from third parties (including an MLS) and may be delayed, incomplete, or subject to the originating MLS or listing broker’s rules.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to purchase products, enroll in courses, or request real estate services. The Site is not directed to children. You are responsible for complying with the laws of the place from which you access the Site.
3. Accounts
Some features may require an account. You agree to provide accurate information, keep credentials confidential, and notify me promptly of unauthorized use. I may suspend or close accounts that violate these Terms, appear fraudulent, or create risk to other users or to the Site.
4. Digital Products: E-Books and Downloads
When you purchase an e-book or other digital file, you receive a limited, personal, non-exclusive, non-transferable, revocable license to download and use that product for your own personal, non-commercial use, unless the product page says otherwise.
You may not, without prior written consent: resell, sublicense, or share the files or login credentials; copy substantial portions into other commercial products or courses; remove copyright or trademark notices; or use the content to build a competing product.
Ownership of the products stays with Alexander Probert or licensors. Delivery is typically by email link, account download, or similar electronic means. You are responsible for compatible devices and software.
5. Courses and Educational Content
Courses, workshops, webinars, templates, and similar materials are educational. They are not a substitute for licensed advice on a specific legal, tax, lending, inspection, appraisal, or real estate transaction.
Unless a sales page says otherwise: access is licensed to the purchasing individual only; sharing logins or redistributing lesson files is prohibited; modules may be updated or retired; and completing a course does not confer a professional license, designation, or continuing-education credit unless expressly stated.
Live sessions, if offered, follow the policy on the applicable sales or welcome page. I am not responsible for your internet connection or third-party meeting platforms.
6. Payments
Prices are as stated at checkout and may change before you complete a purchase. You authorize the applicable payment processor to charge the method you provide. You are responsible for taxes not collected at checkout, except where collection is legally required. If a payment fails, is reversed, or is charged back, access to the related product or course may be suspended until resolved.
7. Refunds
Digital goods and course access are generally delivered immediately or shortly after purchase.
- E-books and other instant downloads: refunds are considered if the file is defective and you contact support within 7 days. After a successful download of a working file, sales are generally final.
- Self-paced courses: refund requests within 14 days of purchase may be considered if you have not substantially consumed the course.
- Live cohorts or one-to-one services: as stated on the applicable sales page.
Email the support address in the Contact section with your order details and reason. Approved refunds go back to the original payment method when the processor allows. Please contact me before initiating a chargeback.
Real estate brokerage services (listing, buyer representation, and similar) are governed by the written brokerage agreement—not by this digital-product refund policy.
8. Blog and General Content
The blog and similar editorial content are personal opinions, experiences, and general information. Posts can become outdated. Content may be edited, corrected, or removed at any time. Comments, if enabled, must be lawful and respectful and may be removed at my discretion.
Third-party links, embeds, and tools are provided for convenience. I do not control those sites or their privacy practices.
9. Real Estate Services and Advertising
Past sales, timelines, price changes, neighborhood commentary, or investment illustrations are not guarantees. Markets, rates, property condition, title, insurance, and parties’ circumstances vary.
All real estate advertising on the Site is intended to comply with applicable license-law advertising rules, Chad and Sandy brokerage policy, MLS rules where listings are displayed, and fair housing laws. User-submitted listing content that appears discriminatory or non-compliant may be refused or edited.
Submitting a form, booking a call, downloading a guide, or buying an educational product does not make me your agent. Do not treat informal emails or messages as contractual commitments on a specific property.
Licensed activity is limited to jurisdictions where Alexander Probert (and the supervising broker, if required) is authorized to practice. Content visible worldwide does not mean representation is available everywhere.
Mentions of lenders, inspectors, title companies, software, vendors, or other products are independent unless a signed agreement says otherwise. Affiliate or referral relationships will be disclosed where required (including FTC endorsement guidelines). Evaluate third parties yourself before hiring them.
10. Intellectual Property
The Site—including text, graphics, logos, photos, videos, course materials, e-books, and templates—is owned by Alexander Probert or licensors and protected by intellectual property laws. The names Alexander Probert, alexanderprobert.com, and related marks, as well as Chad and Sandy / chadandsandy.com as used for brokerage identification, are used as applicable trademarks or business names.
You may view and print reasonable portions of public pages for personal use. You may not scrape the Site in a way that overloads systems, systematically copy course or e-book content, or use the marks in a way that suggests sponsorship without permission.
If listing photos or remarks originate from an MLS or another broker, those parties may retain copyright. Redistribution of MLS data except as allowed by applicable MLS rules is prohibited.
11. User Content
If you post comments, testimonials, or other material (“User Content”), you grant Alexander Probert a worldwide, non-exclusive, royalty-free license to use, display, and reproduce that content in connection with operating and promoting the Site. You represent that you have the rights to that content and that it does not violate the law or others’ rights.
Testimonials reflect individual experiences. Results vary. Testimonials may be declined or edited for length, clarity, or advertising compliance without changing their substantive meaning.
12. Prohibited Uses
You agree not to: use the Site for any unlawful purpose, including housing discrimination; attempt unauthorized access to accounts, courses, or systems; interfere with security or overload infrastructure; harvest other users’ personal information; impersonate Alexander Probert, Chad and Sandy, or another person; upload malware; or wholesale-copy Site content to build a competing product.
13. Privacy
Personal information is handled as described in the Privacy Policy on alexanderprobert.com. Do not submit Social Security numbers, full financial account numbers, or unencrypted identity documents through generic contact forms.
14. Disclaimer of Warranties
THE SITE, BLOG, E-BOOKS, COURSES, TEMPLATES, MARKET COMMENTARY, AND ANY REAL ESTATE INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES ARE DISCLAIMED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
The Site may not be uninterrupted or error-free. Educational content may contain mistakes. You are responsible for verifying information that matters to a transaction or business decision.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALEXANDER PROBERT AND ANY AFFILIATED BROKERAGE, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SITE, DIGITAL PRODUCTS, OR COURSES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR COURSE GIVING RISE TO THE CLAIM DURING THE THREE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Nothing here limits liability that cannot be limited under applicable law, including certain liability under a signed brokerage agreement, or liability for fraud or willful misconduct. A signed listing, buyer-broker, or similar agreement controls over this section for that real estate engagement.
16. Indemnification
You will defend and indemnify Alexander Probert and affiliated brokerage personnel from claims, damages, losses, and reasonable attorneys’ fees arising out of your misuse of the Site, your User Content, your violation of these Terms, or your violation of law or third-party rights.
17. Third-Party Services
Checkout, email, course hosting, scheduling, and analytics may be provided by third parties. Their terms and privacy policies apply to their services. I am not responsible for their outages or acts beyond reasonable control.
18. Copyright Complaints
If you believe content on the Site infringes your copyright, send a notice that substantially complies with the DMCA to the contact email below, including your contact information, identification of the work and the URL of the allegedly infringing material, a good-faith statement, a statement under penalty of perjury that you are authorized to act, and your signature. Content may be removed and repeat infringers terminated in appropriate circumstances.
19. Changes
The Site and these Terms may be updated at any time. The “Last Updated” date will change when revisions are posted. Continued use after changes take effect is acceptance. If you do not agree, stop using the Site.
20. Termination
You may stop using the Site at any time. Access, including course access, may be suspended or ended if you materially breach these Terms, if required by law, or if the Site is discontinued. Survival provisions include intellectual property, disclaimers, limitation of liability, and indemnification. Paid license rights for an e-book you already downloaded remain subject to Section 4 unless terminated for your breach.
21. Governing Law
These Terms are governed by the laws of the state where Alexander Probert principally offers licensed real estate services, without regard to conflict-of-law rules, except that real estate licensing and brokerage duties follow the law of the jurisdiction where the licensed activity occurs.
Before filing a claim related to the Site or digital products, email the address below and try in good faith to resolve the issue for 30 days. Venue for permitted court actions relating to the Site shall be the state or federal courts in that same state, subject to any non-waivable consumer rights you may have.
22. Miscellaneous
These Terms, the Privacy Policy, and any additional terms at checkout or in a signed brokerage agreement are the entire agreement regarding the Site. A signed listing, buyer-broker, or similar agreement controls for that real estate engagement. If a provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; they may be assigned in connection with a reorganization or sale of assets.
